Terms of Service

These Terms of Service (“Terms”) govern your access to and use of salmon.systems, other websites operated by Archipelo, Inc. that link to these Terms, and any Salmon software, downloads, command-line tools, SDKs, APIs, developer tools, accounts, technical previews, documentation, or related products and services that Archipelo makes available under these Terms (collectively, the “Services”).

The Services are provided by Archipelo, Inc. (“Archipelo,” “we,” “us,” or “our”). Archipelo develops Salmon, Execution Verification Infrastructure for autonomous multi-actor software systems.

By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, do not access or use the Services.

Certain Services may be subject to additional or separate terms. If additional or separate terms apply, those terms will control with respect to the applicable Service.

1. Use of the Services

You may use the Services for lawful purposes and in accordance with these Terms and any documentation or usage limits applicable to the Services.

You may not:

• use the Services in violation of applicable law;
• interfere with or disrupt the operation or security of the Services;
• attempt to gain unauthorized access to the Services or related systems;
• access or use the Services beyond the scope authorized by Archipelo;
• circumvent technical restrictions or security measures;
• reverse engineer, decompile, or attempt to derive source code from any non-public portion of the Services, except to the extent such restrictions are prohibited by applicable law;
• use automated means to access the Services in a manner that materially disrupts or burdens their operation; or
• use the Services to distribute malicious code or engage in fraudulent, abusive, or unlawful activity.

2. Accounts and Access

Some Services may require an account or access credentials. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

You must provide accurate information when creating or maintaining an account and promptly notify us if you become aware of suspected unauthorized access or use.

You may not share access credentials, API keys, or other authentication mechanisms except as expressly authorized by Archipelo. Your use of the Services is subject to any technical, usage, rate, or access limits that Archipelo makes applicable to the relevant Service.

We may suspend or terminate access to the Services where reasonably necessary to protect the Services, enforce these Terms, or comply with applicable law.

3. Software and Developer Tools

Subject to these Terms and any additional terms accompanying a Service, Archipelo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access, download, install, and use the Services made available to you, solely for their intended purpose and within the scope authorized by Archipelo.

No rights are granted except as expressly provided in these Terms or other applicable terms.

Open-source components, third-party software, or other materials identified as subject to separate license terms are governed by those terms.

4. Previews and Experimental Features

Archipelo may make alpha, beta, experimental, evaluation, or technical-preview Services available from time to time.

These Services may be incomplete, modified, suspended, or discontinued and may be subject to additional limitations identified when they are made available.

Unless otherwise stated, they are provided for evaluation and testing purposes and should not be relied upon for production use.

5. Intellectual Property

The Services and their content, including software, code, text, graphics, diagrams, documentation, research, designs, trademarks, logos, and other materials (“Content”), are owned by or licensed to Archipelo and are protected by applicable intellectual property laws.

Archipelo, Salmon, and associated names, marks, and logos are trademarks or other protected identifiers of Archipelo. Other names and marks appearing in the Services belong to their respective owners.

You may view and use publicly available Content for lawful informational and business purposes. Except as permitted by applicable law or with our prior written permission, you may not reproduce, modify, distribute, sell, license, or commercially exploit substantial portions of the Content.

No rights in Salmon software, protocols, technology, intellectual property, or other proprietary materials are granted except as expressly stated in these Terms or other applicable terms.

6. Information and Technical Content

The Services may contain information about Salmon, including software architecture, protocols, research, technical concepts, current capabilities, and areas of ongoing or planned development.

Forward-looking descriptions are provided for informational purposes and do not constitute a contractual commitment to deliver any particular feature, capability, integration, or service.

We work to keep information provided through the Services useful and accurate, but Content may be changed, updated, or removed without notice.

Technical and other informational Content does not constitute professional advice.

7. Feedback

If you voluntarily provide feedback, suggestions, or ideas about Salmon or the Services, Archipelo may use them without restriction or obligation to you.

Please do not submit confidential information through the Services unless we have agreed to receive it confidentially.

8. Third-Party Services

The Services may contain links to, integrate with, or otherwise provide access to software, websites, services, or resources operated by third parties.

Archipelo does not control and is not responsible for third-party services, content, security, availability, or privacy practices. Your use of third-party services is governed by the terms and policies of the applicable third party.

9. Privacy

Our collection and use of personal information in connection with the Services are described in our Privacy Policy.

10. Disclaimers

To the fullest extent permitted by applicable law, the Services and Content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

Archipelo disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components, or that Content will always be complete, accurate, or current.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Archipelo and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your access to or use of, or inability to access or use, the Services.

To the fullest extent permitted by applicable law, Archipelo's aggregate liability arising out of or relating to the Services or these Terms will not exceed $100.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.

12. Suspension and Termination

We may suspend or terminate your access to the Services if you violate these Terms, create risk or potential legal exposure for Archipelo or others, or where suspension or termination is reasonably necessary to protect the Services or comply with applicable law.

You may stop using the Services at any time.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitation of liability, and governing law.

13. Changes to the Services or Terms

We may modify, suspend, or discontinue all or any part of the Services and may update these Terms from time to time.

When we update these Terms, we will update the “Last Updated” date above. If changes are material, we may provide additional notice where appropriate or required by law.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Services will be subject to the jurisdiction of the state and federal courts located in Delaware, except where applicable law provides otherwise.

15. General

These Terms constitute the entire agreement between you and Archipelo regarding the Services governed by these Terms, except where additional or separate terms apply to a particular Service.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

Archipelo's failure to enforce any provision of these Terms does not waive its right to do so later.
